What is a Planning Agreement?
A planning agreement is a legal agreement between a planning authority (e.g. Randwick City Council) and a developer. Under a planning agreement, the developer agrees to provide contributions to deliver public benefits to the community.
Why has the Draft Planning Agreements Policy been updated and what are the changes?
In 2021, the Department of Planning and Environment released the new Planning Agreements Practice Notes, providing detailed guidance on preparing and negotiating planning agreements.
Council's Draft Planning Agreements Policy 2024 now includes the revisions outlined in the updated practice note, and includes the following changes:
Additional objectives, purposes, principles and considerations covering the intended use of the policy and processes of entering into Planning Agreements.
Alignment with state, district and local strategic planning frameworks as well as Council’s integrated planning framework in terms of planned local infrastructure works and public facilities.
Clarification on types of public purposes that Council seeks to cover in Planning Agreements as well as deletion of vague references in order to promote and improve transparency between Council and Stakeholders.
